xCraft Enterprises, Inc (“XCraft” “we” or “us”) operates www.xcraft.io, related subdomains and other merchandising channels including web and mobile sites or applications, forums and social media platforms (collectively, the “Site“).  XCraft is committed to ensuring the privacy and protection of users of the Site. We collect personal information that is relevant to the purpose of the Site, which is to provide an online platform for you to learn about and purchase XCraft products. The following discloses our information-gathering and dissemination practices for the Site.

Changes to this Privacy Policy are discussed at the end of this document.  Each time you use the Site, however, the current version of this Privacy Policy will apply.  Accordingly, each time you use the Site you should check the date of this Privacy Policy (which appears at the end of this document) and review any changes since the last time you used the site.

Conditions of Use:

If you decide to visit the Site, your visit and use of the Site and any possible dispute over privacy is subject to this Privacy Policy and our Terms of Use, which includes governing law and venue for any dispute that may arise.

Types of Information Collected:

Traffic Data

As you navigate within the Site, we may automatically track and collect technical information about your computer, tablet, mobile device, or other equipment that you use to access the Site. This information includes IP address, device specifications, domain server, and browser specifications. As you use our Site, we may collect information about how you use the Site and the pages you access.

Personal Data

If you purchase a product from us while using the Site, we may request that you provide us with information that personally identifies you. Personal information may include your name, e-mail, zip code, birth date, age, address, credit card number, and geographic location.

Children:

You must be 18 years or older to use the Site.  We do not specifically collect information about children.

Storage of Your Personally Identifiable Information:

XCraft uses Squarespace for hosting the Site and for securely storing any information collected on the site. We may also from time to time transmit and/or store data using cloud computing services.

Use of Your Personally Identifiable Information:

We do not trade, rent, or share your personally identifiable information with third parties without your express written consent, except as specifically set forth in this Privacy Policy.

Your personally identifiable information may be used by us to process and validate any orders of products purchased on the Site, to contact you when necessary, and to send email notifications of new Site and/or product features. If you purchase a product via our Site you may provide us with credit card information, which will only be used to process your purchase.  We will not disclose your credit card details to any third parties unless necessary for payment processing or ordered by law enforcement or judicial order.  Such third-party processors’ use of your personal information is governed by their respective privacy policies which may or may not contain privacy protections as protective as this privacy policy. Payments on the Site are currently processed and managed using Stripe.

Traffic data and personal data may be used by XCraft on an aggregate (i.e. group) basis for editorial and feedback purposes, for marketing and promotional purposes, for statistical analysis of users’ behavior, for product development, for Site improvement, and to inform advertisers of how many visitors have seen or clicked on their advertisements or viewed their promotions, if applicable. In these cases, data is maintained and reviewed on an aggregate basis. We may share this information with our customers and other parties, but when we do so it will not include personally identifying information. In addition, we use traffic and personal data to customize and tailor your experience on the Site to help us display content and provide features and functionality that we think you may be interested in.

We may also disclose your traffic data and personal data to third parties, without further notice to you, when we believe in good faith that such disclosure is appropriate to: bill you for any products you purchase via the Site, to send out emails on our behalf, protect the rights, property or safety of XCraft, the Site, our users or others; enforce our terms and conditions of usage; comply with law, a court order or other legal process; as requested by any regulatory agency including state and federal administrative entities having jurisdiction over the subject matter; and to facilitate the maintenance or hosting of the Site by an affiliate or service provider engaged to do so, subject to that party’s agreement to comply with this Privacy Policy.

If you opt-in to receive XCraft marketing materials, XCraft may email you about products and services that XCraft believes may be of interest to you.  XCraft may also provide you email information to third parties, so that those third parties may directly contact you about additional products and services.  Any emails that you receive from XCraft will contain an easy automated unsubscribe link so that you can opt-out of any marketing emails if you no longer want to receive them.  If, after you opt-in, you change your mind, you may contact XCraft to opt-out of receiving any XCraft marketing materials by emailing support@xcraft.io or mailing your request to: XCraft, 313 E. BY USING THE SITE, YOU CONSENT TO THE USE AND DISCLOSURE OF YOUR PERSONALLY IDENTIFIABLE INFORMATION AS DESCRIBED IN THIS “USE OF YOUR PERSONALLY IDENTIFIABLE INFORMATION” SECTION.  YOU ASSUME ALL RESPONSIBILITY FOR ANY LOSS OF PRIVACY OR OTHER HARM RESULTING FROM YOUR VOLUNTARY DISCLOSURE OF PERSONALLY IDENTIFYING INFORMATION.

Cookies:

Your browser may accept small identifying files (“cookies”) from our system that are placed on your computer. A cookie is a string of information that a website stores on a user’s computer, and that the user’s browser provides to the Site each time the user submits a query to the Site. Information collected from cookies is used by us to evaluate the effectiveness of our Site, analyze trends, and administer the Site. The information collected from cookies allows us to determine such things as which parts of our Site are most visited and difficulties our visitors may experience in accessing our Site. With this knowledge, we can improve the quality of your experience on the Site by recognizing and delivering the most desired features and information, as well as by resolving access difficulties.

XCRAFT.IO USERS WHO DO NOT WISH TO HAVE WEB COOKIES PLACED ON THEIR COMPUTERS SHOULD SET THEIR BROWSERS TO REFUSE WEB COOKIES BEFORE ACCESSING THE SITE, WITH THE UNDERSTANDING THAT CERTAIN FEATURES OF SITE MAY NOT FUNCTION PROPERLY WITHOUT THE AID OF WEB COOKIES.  SITE USERS WHO REFUSE WEB COOKIES ASSUME ALL RESPONSIBILITY FOR ANY RESULTING LOSS OF FUNCTIONALITY.

Web Beacons:

A “Web Beacon” is an object that is embedded in a web page that is usually invisible to the user and allows website operators to check whether a user has viewed a particular web page. XCraft may use Web Beacons on the Site to count users who have visited particular pages. Web Beacons are not used to access users’ personally identifiable information; they are a technique XCraft may use to compile aggregated statistics about Site usage. Web Beacons collect only a limited set of information including a cookie number, time and date of a page view, and a description of the page on which the Web Beacon resides.

You may not decline Web Beacons. However, they can be rendered ineffective by declining all cookies or modifying your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis. Third parties are not permitted to use Web Beacons on the Site.

Google Analytics:

The Site may use Google Analytics to help analyze how users use the Site. The tool uses cookies to collect standard Internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of the Site (including IP Address) is transmitted to Google. This information is then used to evaluate visitors’ use of the Site and to compile statistical reports on website activity for XCraft.

We will never (and will not allow any third party to) use the statistical analytics tool to track or to collect any personally identifiable information of visitors to the Site. Google will not associate your IP address with any other data held by Google. Neither we nor Google will link, or seek to link, an IP address with the identity of a computer user. We will not associate any data gathered from the Site with any personally identifiable information from any source, unless you explicitly submit that information via a fill-in form on our website.

Do Not Track Signals:

Some web browsers have a “Do Not Track” preference that transmits a “Do Not Track” header to the websites you visit with information indicating that you do not want your activity to be tracked.  We currently do not respond to browser “Do Not Track” signals.

Linked Sites:

The Site may contain links to Web sites operated by third parties, including third-party sites where you may obtain information about or access certain content, products or services.  These third parties may collect personal information from you in connection with such content, products and services. We are not responsible for the content or privacy practices of any such sites.  You should review any third party privacy policy or terms that govern your use of such sites or applications.

Security:

The Site and Services have security measures to protect against the loss, misuse and alteration of the information within our control. We have put in place reasonable and appropriate administrative, technical, and physical safeguards and procedures to maintain the security of the information we collect and the information that is transmitted by users through use of the Site. These measures, like any information security effort, may be circumvented or hacked, and we do not guarantee security.

Limitation of Liability

IN NO EVENT SHALL XCRAFT BE LIABLE FOR ANY LOSS OR DAMAGES INCLUDING WITHOUT LIMITATION, INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGES, OR ANY LOSS OR DAMAGES WHATSOEVER ARISING FROM OR IN CONNECTION WITH THE COLLECTION, USE AND RETENTION OF PERSONAL INFORMATION.

XCraft may, in its sole discretion, change this Privacy Policy from time to time.  Any and all changes to XCraft’s Privacy Policy will also be reflected on this page.  Unless XCraft obtains your express consent, any revised Privacy Policy will apply only to information collected after such time as the revised Privacy Policy takes effect, and not to information collected under any earlier Privacy Policies.  XCraft encourages visitors to frequently check this page for any changes to its Privacy Policy.
